VIRGINIA--impending execution

Supreme Court asked to stop Newport News man's execution----Kent Jermaine Jackson is scheduled to die July 10 for the murder of 79-year-old Beulah Mae Kaiser in 2000.


Lawyers for a Newport News man scheduled to die for killing his 79-year-old neighbor are asking the Supreme Court to halt his execution, claiming his trail was unfair.

Kent Jermaine Jackson, now 26, is scheduled to die by lethal injection July 10 for the April 2000 death of Beulah Mae Kaiser, who was sexually assaulted, beaten and stabbed in her home at River Drive Apartments in Newport News.

Jackson's attorneys claim the prosecutor unfairly removed black potential jurors and biased the jury by comparing the worth of Kaiser's life to Jackson's. They also claim the prosecutor never told Jackson he would face the death penalty.

Newport News Commonwealth's Attorney Howard Gwynn said there is no question that Jackson received a fair trial.

"It's our objective to make sure the defendant gets a fair trial. I would not try to endanger anyone's right to a fair trial," Gwynn said Tuesday.

He said Jackson would have known he would be facing the prospect of execution. "When you get the chance of a capital murder conviction, it's assumed you face the death penalty," he said.

"I would simply say the facts and the law justified we seek the death penalty, and the jury agreed with our assessment."

The case was prosecuted by former Chief Deputy Commonwealth's Attorney Matt Danielson, who left Gwynn's office in 2003 to work as a criminal defense and personal-injury attorney. Danielson was unavailable for comment Tuesday.

Gwynn, who visited the murder scene in 2000, described Kaiser's sexual assault and murder as "horrific."

According to Daily Press reports of the final day of his trial, Dec. 24, 2002, Jackson dared the jury to sentence him to die.

"You've already said I'm guilty of capital murder," he said. "Now finish the job."

The jury unanimously recommended the death sentence.

Circuit Judge Verbena M. Askew, who is now a lawyer in private practice, confirmed the sentence on March 14, 2003.

Joseph Marquis Dorsett, 28, who was with Jackson during the attack on Kaiser, was sentenced to 135 years in prison for sexual assault, robbery and murder.

Kaiser's body was found on the floor of her River Road apartment a few days after her death. Her walking cane had been shoved into her mouth.

The retiree, who lived alone and volunteered as a secretary at the Peninsula Rescue Mission's homeless shelter, was preparing to enter her apartment when she was attacked, investigators said.

A man who beat and stabbed his 79-year-old neighbor to death while he and a friend ransacked her apartment is schedued to die by lethal injection Thursday, barring last-minute intervention by the governor or federal courts.

Kent Jermaine Jackson, 26, is set to be executed at 9 p.m. at the Greensville Correctional Center in Jarratt for the 2000 death of Beulah Mae Kaiser. Kaiser was also sexually assaulted in her Newport News apartment and her cane was crammed into her mouth with such force that it knocked out most of her teeth and broke her jaw.

"She would have given these guys anything they asked for had they asked for it, and she didn't have much," said Lindsay Poteat, director of the Peninsula Rescue Mission, a Newport News homeless shelter where Kaiser volunteered.

Poteat said Kaiser moved into the apartment where she died after losing the home, which she and her husband built on the James River, while trying to help her adopted son financially.

The murder went unsolved for more than a year before DNA from a cigarette butt left in Kaiser's apartment led police to Jackson and Joseph Marquis Dorsett, who lived together in an apartment across the hall from Kaiser.

Jackson confessed to beating, stabbing and robbing Kaiser and was sentenced to death in 2003.

Dorsett was convicted for his role and sentenced to 135 years in prison.

Wednesday night, Jackson's lawyers filed a petition with the 4th U.S. Circuit Court of Appeals seeking to halt the execution after a federal judge rejected their request for a temporary restraining order.

Jackson would be the third Virginia inmate put to death in less than two months following a brief moratorium on capital punishment while the U.S. Supreme Court determined whether lethal injection amounted to cruel and unusual punishment. One more execution is scheduled later this month.

Jackson and another 26-year-old inmate are the youngest of the 17 on Virginia's death row. He would be the 101st inmate executed in Virginia since the U.S. Supreme Court reinstated capital punishment in 1976. Only Texas, with 406, has executed more inmates.

JARRATT, Va. - A Virginia man who beat and stabbed to death his 79-year-old neighbor has been put to death.

Kent Jermaine Jackson was pronounced dead at 9:18 p.m. Thursday at the Greensville Correctional Center in Jarratt. It took about 15 minutes for him to die.

Jackson was sentenced to death for the 2000 death of Beulah Mae Kaiser, who was beaten, stabbed and sexually assaulted. Her cane was crammed into her mouth with such force that it knocked out most of her teeth and broke her jaw.

Jackson's last words were as follows: "You all can't kill me. I'm the king. Remember me like you remember Jesus. I'll be back."

Jackson and another 26-year-old inmate were the youngest of the 17 on Virginia's death row.
